Freehold Enfranchisement
If you are flat owners of qualifying premises this simply means buying the freehold and the 1993 Leasehold Reform Housing and Urban Development Act allows you to buy the freehold of the building (providing you have the required majority of qualifying tenants participating) from the freeholder, and obliges the freeholder to sell, at a price which is either agreed between the parties or determined by a Tribunal.
We can help you determine if you fall within the category of qualifying tenants, and if the building is a qualifying building, and we can advise on the likely level of costs involved, the safeguards you can put in place to protect all participating members of the group wanting to buy the freehold.
You are able to buy the freehold even if you have an absent freeholder (see missing freehold section ) and we can advise you on what happens after you have bought your freehold, and discuss any necessary changes to the leases.
If you own a house subject to a long lease then you may be eligible under the terms of the Leasehold Reform Act 1967 to buy the freehold of the house. Once again we will help you determine if you and the premises qualify and can recommend a specialist surveyor to discuss the price that should be in your notice of offer.
